GuavaHR

The notice describes how the personal information of GuavaHR web platform users (the “Service”) is processed.

The personal data controller is guavaHR OÜ, registry code 14492709, address Harju maakond, Tallinn, Kristiine linnaosa, Mustamäe tee 6b, 10621 (hereinafter “GuavaHR”).

GuavaHR is the processor of the data obtained during the use of the Service (including news feed, reviews, messages, groups, comments, photos, videos, etc.) and the owner of the profile (for example an employer) is the data controller.

What personal data do we collect

When registering as a user, we collect your name, surname, company name and email address. It is possible to add a profession, description and photo to an organisation’s profile. We process the specified data in order to fulfill the contract (arising from Terms of Use of GuavaHR platform).

In addition GuavaHR processes personal data with cookies and other similar solutions (https://guavahr.com/cookie-policy/).

The news feeds, feedbacks, posts, groups, comments, photos, videos and files saved on GuavaHR platform contain personal data. This data is generated during the internal communication of the organisation’s employees/members. Such data shall be processed for the purpose of performing the contract of employment.

If the processing of personal data goes beyond the usual internal communication in an employment relationship, the profile owner (organisation) will inform the employees/members of the additional terms of processing (e.g. organisation of work) and, if necessary, request consent for data processing.

For what purpose do we process personal data

GuavaHR processes personal data for the following purposes:

  • providing and managing the Service;
  • identification of users;
  • communication with users;
  • to ensure the functioning and provision of the Service;
  • for developing the Service;
  • devising statistics from anonymized data.

Owner of an organisation’s profile (e.g. employer) processes personal data for the purposes of organising and administration of internal communication.

Access and transfer of personal data

GuavaHR employees have access to personal data to the extent that is necessary to carry out their duties.

GuavaHR can transmit personal data of users to third parties (e.g. for technical support) if it is strictly necessary for the provision of services and compliance with the Terms.

Owner and administrator of an organisation’s profile have access to the entirety of personal data that is shared on GuavaHR platform.

Personal Data Security

Personal data is stored on the servers located in the European Union.

GuavaHR has adopted appropriate technical and organizational measures to ensure the security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage. We have entered into data processing agreements with companies to which we transfer personal data in ensuring the operation of the Service.

Rights

User has the right to demand the correction of personal data, get access to it and, if necessary, object to the processing of personal data.

User can request the removal of personal data, after which the organisation’s profile administrator will be informed of the conditions and the timeframe for removal of personal data. The organisation’s profile administrator does not delete personal data if there is a legal basis for the preservation thereof.

User has the right to obtain personal data in machine-readable format and transmit the data to another processor of personal data.

To exercise their rights, refer to the organisation’s profile administrator.

Personal data storage

User profile personal data is stored until the user deletes their GuavaHR profile. News feed, reviews, publications, groups, comments, photos, videos, files, etc., are stored on the GuavaHR platform as long as the organisation’s profile administrator retains them.

Personal data may be stored in anonymous form for statistical and analytical purposes.

In the event of a dispute, personal data is stored until the parties reach an agreement or the statute of limitations expires.

Other conditions

With the users’ consent GuavaHR can send marketing notifications to users’ e-mail address. The user may unsubscribe from marketing notifications at any time.

In case of personal questions, inquiries or complaints regarding personal data, contained within news feeds, reviews, posts, groups, comments, photos, videos and files saved on the GuavaHR platform, please contact the owner or administrator of the organisation’s profile.

The user has the right to file a complaint with the Data Protection Inspectorate at info@aki.ee.

GuavaHR has the right to change the conditions of this Privacy Notice at any time. GuavaHR will notify you of the changes to the data protection conditions on its website. The owner of an organisation’s profile (employer) informs the members of the privacy requirements, which are applicable in the employment relationship.
